Example terms of reference

Review of Animal Welfare Act Review 2020
  1. Determine whether the objects of the Act reflect and promote contemporary best practice in animal welfare such as recognition of the ability of animals to express innate behaviours, and if necessary recommend appropriate legislative amendments.
  2. Identify any impediments to the effective enforcement of the Act and any related regulations, with specific attention to the powers of inspectors and the prosecution of offenders.
  3. Consider amendments to policies, standards and legislation to achieve contemporary best practice in animal welfare regulation, including a compliance regime based on standards prescribed by regulation, and if necessary recommend appropriate legislative amendments.
  4. Make recommendations on how compliance with the Act can be promoted, including consideration of the prosecutorial framework, and if necessary recommend appropriate legislative amendments.
  5. Advise the Minister on any other matters relevant to the operation and effectiveness of the Act.

 

Review of Workers' Compensation and Injury Management Act 1981

35. The terms of reference for the review were approved by the Minister following consultation with WorkCover WA and the SRG. The terms of reference for the review were:

  • Create an improved structure for the Act, to enhance the readability and consistency of the legislation.
  • Improve the efficiency of the legislation to respond to changing circumstances.
  • Address anomalies which have been identified through past experience in the operation of the Act, including matters raised in the evaluation of the 2005 reforms or by stakeholders.
  • Address specific policy issues, such as age discrimination, as identified by stakeholders.
36. It should be noted the review did not involve a broad ranging examination of benefits and entitlements, or other fundamental aspects of the design of the scheme.

 

Review of Food Act 2008

On 1 December 2021, the Minister for Health Hon Roger Cook announced the statutory review of the Food Act 2008. The Review will examine the operation and effectiveness of the Act in meeting its objects to ensure food for sale is both safe and suitable for human consumption and prevent misleading conduct in connection with the sale of food.

The statutory review shall:

1. Examine the operation and effectiveness of the Act in meeting its objects to:

  • ensure food for sale is both safe and suitable for human consumption
  • prevent misleading conduct in connection with the sale of food
  • provide for the application in this State of the Food Standards Code.

2. Identify, including through analysis of stakeholder submissions, any issues with the operation and effectiveness of the Act, including:

  • interpretation
  • offences related to food
  • emergency powers
  • powers of entry
  • inspection and seizure
  • improvement notices and prohibition orders
  • taking and analysing samples
  • auditing
  • registration of food businesses
  • administration
  • procedural and evidentiary provisions and
  • any other relevant matter

3. Make recommendations that will strengthen and support the objects of the Act being met, and promote greater regulatory effectiveness.

 

Review of Coroners Act 1996

Review of Coronial Practice in Western Australia

I, Jim McGinty, Attorney General for the State of Western Australia. HAVING REGARD TO s.57 of the Coroners Act 1996 (WA), hereby refer the following matter to the Law Reform Commission of Western Australia.

The Law Reform Commission of Western Australia is to review and report on the jurisdiction and practices of the coronial system in Western Australia, including the operation of the Coroners Act 1996 (WA) ("the Act").

In carrying out this review, the Commission should consider:

  • any areas where the Act can be improved
  • any desirable changes to jurisdiction, practices and procedures of the Coroner and the office that would better serve the needs of the community
  • any improvements to be made in the provision of support for the families, friends and others associated with a deceased person who is the subject of a coronial inquiry, including but not limited to, issues regarding autopsies; cultural and spiritual beliefs and practices; and counselling services, etc
  • the provision of investigative, forensic and other services in support of the coronial function
  • any other related matter.

Review of coronial laws in WA

SHARE YOUR EXPERIENCE

The Law Reform Commission is currently reviewing coronial laws, practices and procedures and the operation of the Coroner's Court in Western Australia. The review will examine all aspects of the coroner's jurisdiction including death investigation, post mortem, inquests and coronial counselling.

The Commission invites people who have had dealings with the Coroner's Court to share their experiences. Comments from the public will help the Commission to make recommendations to improve coronial legislation and practice for the benefit of the community. The Commission's website features a Background Paper and survey to assist people to focus their comments.

Review of Fish Resources Management Act 1994

New legislation for a sustainable aquatic future
PUBLIC COMMENTS INVITED

The Minister for Fisheries, the Hon Norman Moore has directed the Department of Fisheries to investigate and scope the requirements for a new Western Australian Act of Parliament to ensure the sustainable development and conservation of the State's aquatic biological resources in the 21st Century.

A public discussion paper "A sea change for aquatic management” has been released which outlines the framework for a new Western Australian Act of Parliament to replace the Fish Resources Management Act 1994.

Your views are invited on any matters that should be considered in the formulation of the new Act.

Review of Heritage of WA Act 1990

PUBLIC SUBMISSIONS CLOSING SOON

The Office of Heritage is seeking public comment on a series of proposals that will shape the future of a new Heritage Act.

The review of the Heritage of Western Australia Act 1990 was announced by the Hon. GM (John) Castrilli MLA Minister for Local Government; Heritage; Citizenship and Multicultural Interests in April.

The Discussion Paper, released in September, is the second phase of public consultation. Public submissions close on Friday, 2 December 2011.
