Scope of work for motor vehicle dealer licence holders.

The below information provides a description of activities which a Western Australia (WA) licensed motor vehicle dealer is permitted to perform. If you are a WA licensee visiting another state under AMR, you are only allowed to perform the activities listed below.

Scope of work

A motor vehicle dealer is someone who:

  • makes a business out of buying and selling vehicles;
  • acts as an agent for others for the purpose of buying or selling cars, including selling by auction;
  • acts as a financier for the purposes of buying or selling cars;
  • operates a car rental business; or
  • sells or exchanges four or more vehicles in any 12 month period to, or with, persons who are not dealers.

Specific activities

Dealers issued a licence after 25 September 2021, were endorsed with one or more of the following categories in any combination:

Dealers in WA are usually subject to a condition that does not allow sales on consignment which requires a trust account

WA requirements

To get a WA licence

  • Must have a prescribed qualification or equivalent knowledge.
  • Must have an Australian police check.
  • Must have sufficient material and financial resources available.
  • Must operate out of a registered premises.
  • Must be of person of good character and repute and a fit and proper person to hold a licence.
  • Must pay an application fee.

To keep a WA licence

  • Must renew licence every three years.

They must comply with the Motor Vehicle Dealers Act 1973, Australian Consumer Law (WA), and the Retail Trading Hours Act 1987, Motor Vehicle Dealers (Licensing) Regulations 1974, Moto Vehicle Dealers (Sales) Regulations 1974, Motor Vehicle Dealers (Prescribed Vehicles) Regulations 1974, and Motor Vehicle Dealers (Infringements) Regulations 2002.
