Scope of work for debt collector licence holders.

The below information provides a description of activities which a Western Australia (WA) licensed debt collector is permitted to perform. If you are a WA licensee visiting another state under AMR, you are only allowed to perform the activities listed below.

Scope of work

A debt collector collects, requests or demands payment of debts on behalf of another person for remuneration.

Specific activities

  • Establish the person being pursued for the debt is liable for the debt.
  • Contact the debtor by any available means only to the extent necessary to recover the debt.
  • Provide information to the debtor to substantiate the debt.
  • Takes possession of mortgaged goods with Court approval or consent from the occupier of the premises.

WA requirements

To get a WA licence

  • Must be cleared by the Commissioner of Police.
  • Must be of person of good character and repute and a fit and proper person to hold a licence.
  • Must be 21 years of age or more.
  • Must lodge a bank guarantee or fidelity bond of at least $6,000 with the Commissioner of Consumer Protection or $10,000 for a company licensee.
  • Must pay an application fee.

To keep a WA licence

  • Must deposit money received in relation to the collection of a debt into a statutory trust account which must comply with the Debt Collectors Licensing Act 1964.
  • Must have appointed auditor and annually audit the trust account.
  • Must comply with the regulations with regard to fees charged.
  • Must renew the licence as required.

Must comply with the Debt Collectors Licensing Act 1964, Debt Collectors Licensing Regulations 1964, Fair Trading Act 2010 and National Credit Code.
