As part of the amendments, the Building Trades Award will be renamed the Building Trades and Labourers (General) Award and the Building Trades (Construction) Award will be renamed the Building Trades and Labourers (Construction) Award.
The scope of the Building Trades and Labourers (General) Award has been varied so that the award applies to all employees not working “on-site”, where the employee is engaged in any of the classifications covered by the award. This award now applies to all types of businesses, regardless of industry, however it does not apply to employees who are covered by another state award.
The scope of the Building Trades and Labourers (Construction) Award will continue to apply to employees working “on-site” in the building and construction industry in any classification mentioned in the award. The Building Trades and Labourers (Construction) Award does not apply to employees who are covered by another state award.
Other amendments to the Area and Scope clause of both awards ensure that the award:
- applies to employees working for labour hire organisations and group training providers;
- does not apply to employers and employees in the national industrial relations system;
- applies to employers who are ‘connected to the State of Western Australia’ and their employees while performing work covered by the award; and
- removes outdated provisions for junior employees.
