Calculating payment for annual, personal and other leave
In the state industrial relations system, full time and part time employees are entitled to paid leave entitlements including annual leave, personal leave, and bereavement leave, under the Minimum Conditions of Employment Act.
Employees paid wholly by commission, percentage reward or piece rates are to be paid the highest of the following for a period of paid leave:
- the rate payable under a WA award, industrial agreement or contract of employment for a period of leave (whichever provides for the higher rate);
- the rate calculated according to the employee’s average weekly earnings during the 365 days immediately before the leave is taken; or
- the applicable minimum rate of pay under the Minimum Conditions of Employment Act.
Where the rate of payment for a period of paid leave is being calculated according to the employee’s average weekly earnings during the 365 days immediately before the leave is taken, the following periods are not included in the calculation:
- a period of unpaid leave; and
- any period during which the employee was stood down in accordance with an award, industrial agreement, contract of employment or legislative provision.
