Dispute Resolution Mechanism for the release of Market Information

Procedure: Dispute Resolution Mechanism for the release of Market Information

Description: This Procedure documents the process for resolving a dispute regarding the disclosure of Market Information. The Procedure outlines:

  • the method by which a notice of dispute is to be provided to the Coordinator;
  • the process by which the Coordinator will resolve disputes;
  • the timeframes of the dispute resolution process; and
  • related processes to be followed by the Coordinator and Rule Participants.

Description: This Procedure outlines the arbitration process as it relates to section 1.42 of the WEM Rules

Further information:  Under clause 1.42.10 of the WEM Rules, the Coordinator of Energy must develop a WEM Procedure which provides further detail on the operation of the GPS Dispute Resolution Mechanism, including the process for referring matters to the Generator Arbitrator, and the reasons where the Coordinator may determine that a Secondary Generator Arbitrator may be used in place of the Primary Generator Arbitrator. 

The Coordinator of Energy's WEM Procedure: Dispute Resolution Process for Existing Transmission Connected Generating Systems states that referrals to dispute resolution must be made using two separate forms:

  • the GPS Dispute Resolution Notice, which is used by the party referring a dispute to the Coordinator of Energy for arbitration; and
  • the GPS Dispute Resolution Notice Response, which is used by the party responding to a dispute referred to the Coordinator of Energy for arbitration.

The Coordinator will consider the information provided in both forms prior to determining whether a dispute is to be referred to arbitration.  The Dispute Resolution Mechanism for Existing Transmission Connected Generating Systems Procedure, and both of the above forms are provided below.
