Civil penalty and conduct provisions for the non-scheme gas pipeline access regime

Energy Policy WA has progressed the National Gas Access (WA) (Part 3) Amendment Regulations 2021 to classify certain Part 23 National Gas Rules relating to the non-scheme gas pipeline access regime as civil penalty and conduct provisions.

The regulations also delete a redundant National Gas Rule reference from the list of civil penalty and conduct provisions in the National Gas Access (WA) (Part 3) Regulations 2009.

This reform:

  • enables the Economic Regulation Authority to have appropriate enforcement measures for the non-scheme gas pipeline access regime; and
  • ensures a consistent national approach, as the Part 23 Rules classified as civil penalty and conduct provisions in Western Australia are now the same as those that apply in all other jurisdictions in Australia.

Submissions closed on 13 July 2020. No comments were received on the proposed regulations.
