NDIS Worker Screening Unit takes prosecution action for man who worked without an NDIS worker check clearance certificate

Department of Communities recently took prosecution action against a Rivervale man for working 15 shifts as a Home Care employee without an NDIS worker check clearance certificate (NDIS Check), after he provided a falsified NDIS Check to his employer.

The NDIS Screening Unit within Communities worked in collaboration with the Western Australia Police Force, with Police laying forgery and uttery charges under the Criminal Code against multiple individuals, including the Rivervale man, for the use of fraudulent NDIS Checks in an attempt to gain employment in the disability sector.  

NDIS Worker Screening was introduced to protect people with disability from experiencing harm from unsafe services delivered under the NDIS.

Working without a valid NDIS Check is an offence under the National Disability Insurance Scheme (Worker Screening) Act 2020 that carries a maximum penalty of imprisonment for 5 years and a fine of $60 000.

The Magistrates Court found that the Rivervale man had engaged in criminal conduct by continuing to work without a valid NDIS Check. The individual, who was also earlier convicted of the Criminal Code offence of forgery and uttery, was fined $200.00 and given a spent conviction.  

Falsifying an NDIS Check is in serious contravention of sector standards and undermines the integrity of the system designed to protect those with disabilities in our community. Communities will continue to take action to ensure people with disability are kept safe.

NDIS workers and providers are encouraged to visit the NDIS Check website to ensure they are complying with worker screening requirements.
