A Permit to Enter is required to search for minerals on private property such as farmland.

You can apply for the Permit using either Mineral Titles Online or Form 2 of the Mining Act 1978, which should be lodged together with a map clearly showing the private land.

The term of a permit to enter shall not exceed 30 days, and the permit only authorises;

the holder (or his agent) to:

  • enter on private land
  • search for minerals
  • detach and remove from the land samples of any vein or lode out-cropping on the surface up to an aggregate weight of 13 kilograms, unless the owner or occupier of the land authorises the taking of additional samples; and
  • mark out a mining tenement, but not mine or otherwise disturb the surface

For a fee, private landowners addresses can be obtained from Landgate. Contact with the landowner should be made before entry.
