Environment notifications and reports for energy resource activities
Energy resource activities in Western Australia, including petroleum, geothermal and pipeline activities, have a range of environment notification and reporting requirements. These requirements are primarily under an approved Environment Plan and/or the Petroleum and Geothermal Energy Resources (Environment) Regulations 2012, the Petroleum (Submerged Lands) (Environment) Regulations 2012 and/or the Petroleum Pipelines (Environment) Regulations 2012.

Reportable incident notifications
If an environment reportable incident occurs, as soon as practicable and within 2 hours, operators must notify the department. An initial notification may be given verbally and followed up in writing by email. Please include all information currently known about the nature, scope and scale of the incident, and any actions taken to avoid or mitigate environmental impacts.

Reportable incident written reports
Operators are required to submit a written report within 3 days after a reportable incident. The report must include, amongst other things, all facts known or that can be found out by reasonable search or inquiry about the incident, any actions taken to avoid or mitigate environmental impacts, and any actions taken or proposed to be taken to prevent recurrence. Recordable incident report
A recordable incident is an incident arising from an activity that ‘breaches an environmental performance objective or environmental performance standard in the Environment Plan’ and ‘is not a reportable incident’.
The operator of an activity is required to submit a written report to DEMIRS of all recordable incidents no later than 15 days after the end of the calendar month in which they occurred.
If no recordable incidents occurred during the month, the report must include a statement to that effect.

Emissions and discharges reports
Operators must monitor all emissions and discharges to any land, air, marine, seabed, groundwater, subsurface or inland waters environment. The operator must submit a written report of emissions and discharges three months after the approval of an Environment Plan and a period of every three months thereafter.

Annual environmental reports
Petroleum, geothermal and pipeline operators are required to report on their environmental performance and compliance with the environment plan’s implementation strategy annually. A final annual or ‘closeout’ environmental report is submitted at the completion of an activity.

Prestart and cessation notifications
Petroleum, geothermal and pipeline operators are required to notify DEMIRS of the start date of the activity prior to commencement, and to notify DEMIRS of the completion date within one week of the activity ceasing.

Commonwealth notification
Offshore titleholders are required to seek approval for petroleum activities in Commonwealth waters from the National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA) and to consult with relevant State/Territory Ministers and/or their departments.
The department should be notified and/or consulted about offshore resource activities that have the potential to impact on values in Coastal Waters or the WA mainland. These activities include petroleum, pipeline or greenhouse gas works. The level of notification or consultation required will depend on the environmental risks and potential environmental impacts of the activity.
