Under regulation 20 of the Environmental Protection (Prohibited Plastics and Balloons) Regulations 2018

In accordance with regulation 20(1) of the Environmental Protection (Prohibited Plastics and Balloons) Regulations 2018, the Chief Executive Officer of the Department of Water and Environmental Regulation (the department) may grant an exemption if it is reasonably necessary to so. The exemption notice below provides a ‘Class exemption’ for businesses supplying prescribed plastic items under specified circumstances provided in the notice.

Note: Plastic takeaway food containers and lids for mine sites with onsite kitchens. This exemption is limited to mine sites where food is made and packaged onsite to be collected by staff. Includes containers for food served hot or served cold with microwaving instructions to ensure it is heated to an appropriate temperature in accordance with the Food Act 2008 and associated standards and regulations.

Other conditions apply, so please read the exemption notice carefully to determine whether the exemption applies to your circumstances.

Reporting requirements

Under this class exemption and to use this exemption, mine site food businesses are expected to provide the following information by 30 August 2024 or within 30 days of adding a new product:

  • business name (of mine site)
  • authorised representative from the mine site organisation using the exemption
  • contact details
  • list of plastic food packaging to use this class exemption
  • image upload (optional).

Manufacturers, distributors and suppliers do not need to submit this same information but please communicate with your mine site food businesses to determine whether information has been provided. Any non-compliance with the exemption notice can lead to enforcement action.
