Class exemption SUP0002/2024/1: Electronic goods using moulded expanded plastic packaging over 25 kg

In accordance with regulation 20(1) of the Environmental Protection (Prohibited Plastics and Balloons) Regulations 2018 the Chief Executive Officer of the Department of Water and Environmental Regulation (the department) may grant an exemption if it is reasonably necessary to so. The exemption notice below provides a ‘Class exemption’ for businesses supplying prescribed plastic items under specified circumstances provided in the notice.

Note: Electronic goods using moulded expanded plastic packaging (Regulation 3BB(1)(c)) weighing greater than 25 kg net product weight.

Other conditions apply, so please read the exemption notice carefully to determine whether the exemption applies to your circumstances.

Reporting requirements

Under this class exemption and to use this exemption, manufacturers, distributors or suppliers are expected to provide the following information by 30 April 2026 or within 30 days of adding a new product:

  • company name
  • authorised representative from the organisation using the exemption
  • contact details
  • list of products captured by the exemption.

Manufacturers, suppliers and retailers do not need to submit the same information if it has already been submitted by another member of the supply chain. Please communicate with your supply chain to determine whether information has been provided. Any non-compliance with the exemption notice can lead to enforcement action.
